Air Charter Service Contract

This Air Charter Service Contract (Hereinafter referred to as “Contract“) shall be considered as an integral part of the Air Charter Flight Quotation submitted by “AIR OCEAN MAROC” (Hereinafter referred to as “AOM“) located at No1 Battani Street, Agdal, Rabat, Morocco for the provision of Air Charter Services (Hereinafter referred to as “Service“). Deviation from the terms and conditions stipulated below shall only be valid in the case of a written confirmation from AOM.

1. Flight Confirmation: This Contract will only be binding in the case that the client accepts the offer submitted by AOM in written form. The receipt of written confirmation from the client shall not be considered as a confirmation of Services by AOM and shall be subject to aircraft availability, obtaining traffic-rights, overflight permits, slots, and all necessary governmental and operational approvals. In the case that authorizations related to performance of Services are not granted by 3rd parties, AOM shall not be held liable for such cases. In such circumstances, AOM reserves its right to ask compensation from the client for the expenses incurred.

2. Cost of Service: The quotation covers the price of standard air charter services including the following components, unless otherwise specified in the special terms and conditions:

● All operating costs incurred in connection with the Service, whether they apply to the aircraft itself, the flight crew, third-party liability and aircraft insurance and, in particular, fuel and lubricant costs.
● Flight crew salaries and allowances.
● Aircraft maintenance costs, support costs and various fees or taxes paid in connection with the Service.

All other costs that may be incurred in connection with the Service and not covered by the Price will be borne by the Customer. De- icing costs will be re-invoiced to the Customer according to the rate charged by the airport in question. The Customer will provide its own transport from the cities of departure and arrival to the airport. AOM reserves the right to amend the Price of the Service to take account of any increase in the cost of fuel, additional landing fees, extra opening hour extensions fee and additional insurance for high-risk countries. Special products, in particular specific catering, are subject to a separate quotation and are not included in the Price. In case any unexpected operational cost (e.g., denied parking for layover, etc.) occur or any additional tax or changes of tax is applicable and published by any airport concerned, AOM will charge Customer accordingly. If number of passengers is lower than agreed in the contract no financial compensation will be granted after the flight. On the other hand, AOM keeps the right to request to the charterer or the Customer an extra cost for every extra passenger on board.

3. Terms of Payment: After signing the contract and the General Terms and Conditions, the Customer must make the payments below to validate the flight:

● 25% of the total amount within 24 hours after signing the contract. ● 50% of the total amount 10 days before the flight.
● 100% of the total amount 72 hours before the flight.

in the cases that the Client will make payment with Credit Card, 3% of quoted price will be charged to the Client. These regulations trigger the firm and definitive reservation of the aircraft. As long as AOM has not received these payments, the plane is not reserved. After expiry of these deadlines and without receipt of these payments, AOM reserves the right to cancel the Service Order, which will give rise to the Penalties provided for in the article above.

4. Cancellation Policy or Delay in Operations by Client:If the Charterer wishes to cancel any Flight or Flights the subject of this Agreement the following rates will be paid forthwith by the Charterer to the intermediary as agreed compensation:

● 25% of the Charter Price if cancelled after contract exchange.
● 50% of the Charter Price if cancelled within 7 days prior to STD.
● 75% of the Charter Price if cancelled 72 hours prior to STD.
● 100% of the Charter Price if cancelled within 24 hours of STD.
Payment should be executed and reflected in AIR AOCEAN MAROC account prior to STD.

5. On-board service: Standard services are included: coffee, tea, pastries or salty/sweet snacks, daily press, drinks, refreshments. Requests for specific catering are subject to a specific quotation and must be made at least 24 hours before departure.

6. Dangerous goods: The Passenger will not be authorized to entrust dangerous goods for carriage by air in accordance with the IATA standard.

7. Luggage: AOM reserves the right to determine the amount of luggage or load to be taken. AOM has always right to check the luggage for security reasons.

8. Cancellation of a Flight: Under inconvenient weather conditions, due to technical problems or related to any unforeseen problems that are beyond AOM’s control; AOM reserves the right to re-schedule the flight program or to cancel the flight.

9. Validity of Quotation: Unless otherwise agreed in written; this quotation is 7 (seven) days valid/limited.

10. Protection of Personal Data

No personal data is collected without your knowledge. In a commitment to respect privacy, Air Ocean Maroc ensures that the collection and processing of personal data are carried out in accordance with Law No. 09-08 of February 18, 2009, concerning the protection of individuals regarding the processing of personal data.

No personal data is transferred to third parties.
